Welcome to VacationHobby, a U.S.-based peer-to-peer paramotor rental marketplace platform operated by VacationHobby, Inc. (“VacationHobby”, “we,” “us,” or “our”). By accessing or using our services, including our website at vacationhobby.com and related systems or software (collectively, the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with these Terms, please do not use the Platform.

1. Platform Overview

VacationHobby provides an online marketplace that enables individuals or businesses in the United States to list, discover, and rent paramotor equipment. We connect users who wish to rent paramotor equipment (“Renters”) with those offering their paramotor equipment for rent (“Owners”).

• Our Role: We act as a neutral intermediary facilitating connections between Renters and Owners. VacationHobby does not own, operate, control, or manage any paramotor equipment listed on the Platform, nor are we a party to any rental agreements formed between Users.
• Services: Our services include account registration, listing creation, booking facilitation, payment processing, and administrative support for rental transactions (collectively, the “Service”).

You acknowledge that paramotor use is inherently dangerous, and you assume all risks associated with renting or listing paramotor equipment through the Platform.

2. Eligibility and Account Registration

To use the Platform, you must meet the following eligibility requirements:

• Be at least 18 years of age and have the legal capacity to enter into binding contracts.
• Register as either a Renter or an Owner by creating an account with accurate, complete, and up-to-date information.
• Undergo identity verification through Veriff and phone verification via Twilio (A2P compliance).

Account Responsibilities:

• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You must notify us immediately at support@vacationhobby.com of any unauthorized access or security breach.
• VacationHobby reserves the right to suspend or terminate accounts for providing false information, failing verification, or violating these Terms.

3. Listings and Rentals

For Owners

• Listing Requirements: Owners may list paramotor equipment, including details such as pricing, location, availability, condition, and images. Listings must:
  
  • Be accurate, lawful, and represent equipment you have the legal right to rent.
  • Include clear descriptions of any skill or certification requirements for Renters (e.g., paramotor pilot training or experience).
  • Ensure equipment is safe, well-maintained, and compliant with applicable regulations.
• Owner Obligations: Owners must:
  
  • Provide equipment in the condition described in the listing.
  • Disclose any defects, limitations, or safety requirements prior to rental.
  • Comply with all local, state, and federal laws, including equipment registration and safety standards.

For Renters

• Booking Process: Renters are responsible for:
  
  • Reviewing listing details, including equipment condition, requirements, and Owner policies.
  • Communicating with Owners to clarify details before booking.
  • Verifying equipment condition (physically or virtually) before use.
• Renter Obligations: Renters must:
  
  • Use rented equipment responsibly, safely, and in accordance with the Owner’s instructions and applicable laws.
  • Possess the necessary skills, training, or certifications required for safe paramotor operation.
  • Return equipment in the same condition as received, subject to normal wear and tear.

General Terms:

• All rental agreements (“Rental Agreements”) are between the Renter and Owner. VacationHobby facilitates but is not a party to these agreements.
• Users must report any issues with listings or equipment to support@vacationhobby.com promptly.

4. Payments and Refunds

• Payment Processing: All transactions are processed securely through Stripe, our third-party payment gateway. VacationHobby acts as a payment facilitator, holding funds in escrow until the rental is completed.
• Fund Release: Funds are released to the Owner after:
  
  • The Renter confirms successful equipment handover and use, or
  • The rental period concludes without a dispute.
• Fees: VacationHobby charges a service fee (detailed at checkout) for facilitating transactions, which is deducted from the payment.
• Cancellation Policy:
  
  • Renter Cancellation: If a Renter cancels a confirmed booking, a $40 cancellation fee is deducted, and the remainder is refunded.
  • Owner Cancellation: If an Owner cancels, the Renter receives a full refund.
  • Disputes: Cancellation disputes are reviewed case-by-case, and VacationHobby’s decision is final.
• Taxes: Users are responsible for any applicable taxes related to their rental transactions.

5. Assumption of Risk and Limitation of Liability

Paramotor activities carry significant risks, including injury, death, or property damage. By using the Platform, you acknowledge and accept these risks and agree to use paramotor equipment at your own risk.

• VacationHobby’s Role: We provide a platform to connect Renters and Owners but do not:
  
  • Inspect, endorse, or guarantee the accuracy, safety, or legality of listings or equipment.
  • Verify User qualifications, skills, or compliance with laws beyond initial account verification.
  • Participate in or control Rental Agreements.
• No Liability: To the fullest extent permitted by law, VacationHobby, its affiliates, officers, and partners are not liable for:
  
  • Damage, theft, injury, financial loss, or legal issues arising from equipment use, condition, or misuse.
  • Inaccuracies in listings or User communications.
  • Disputes between Renters and Owners.
• Dispute Resolution: Rental disputes must be resolved directly between Renters and Owners. Upon formal request and verification, VacationHobby may provide contact details to assist in resolution but will not mediate unless required by law.

6. Identity and Communication Verification

• Verification Process:
  
  • User identities are verified via Veriff.
  • Phone numbers are verified through Twilio A2P SMS registration.
• Account Actions: We may suspend or ban accounts for:
  
  • Failing verification.
  • Suspected fraudulent activity.
  • Violating these Terms or Community Guidelines.
• Communication Consent: By creating an account, you consent to receive SMS, email, or other electronic communications for:
  
  • Account verification, booking updates, and rental confirmations.
  • Marketing and promotional content (opt-out available for non-essential messages).
  • Essential account notifications cannot be opted out of.

7. User Conduct

You agree to:

• Comply with all local, state, and federal laws, including those governing paramotor operation and equipment safety.
• Use the Platform solely for lawful purposes related to paramotor rentals.
• Provide accurate and truthful information in listings, profiles, and communications.
• Not engage in prohibited activities, including but not limited to:
  
  • Posting false, misleading, or offensive content.
  • Using rented equipment for unauthorized purposes (e.g., commercial use without Owner consent).
  • Attempting to bypass the Platform to avoid fees.
  • Harassing, impersonating, or exploiting other Users or staff.
  • Interfering with, hacking, or overloading the Platform’s infrastructure.

Violation of these conduct rules may result in account suspension, termination, or legal action.

8. Disputes and Legal Cooperation

• Dispute Handling: VacationHobby will not intervene in rental disputes unless:
  
  • A formal complaint is submitted with verifiable details.
  • Both parties’ identities and rental history are confirmed.
• Actions We May Take:
  
  • Share User data (e.g., IDs, communications) with law enforcement or courts as required.
  • Temporarily hold payments pending dispute resolution.
  • Suspend or terminate accounts involved in fraudulent or suspicious activity.
• User Responsibility: You agree to cooperate fully with any dispute resolution process initiated by VacationHobby or third parties.

9. Intellectual Property

• Ownership: All content on the Platform, including logos, trademarks, designs, text, and software, is the property of VacationHobby or its licensors and is protected by U.S. copyright and trademark laws.
• Restrictions: You may not copy, reproduce, distribute, or use any Platform content without prior written permission from VacationHobby.
• User Content: By posting content (e.g., listings, images), you grant VacationHobby a royalty-free, worldwide, non-exclusive license to use, display, and distribute such content solely for operating and promoting the Platform.

10. Insurance and Safety

• No Insurance Provided: VacationHobby does not provide insurance for rentals. Renters and Owners are responsible for securing appropriate insurance coverage for:
  
  • Liability, personal injury, and property damage.
  • Equipment loss, theft, or damage.
• Owner Requirements: Owners must ensure listed equipment is insured and disclose insurance requirements in listings.
• Renter Requirements: Renters must verify their insurance covers paramotor use and comply with any Owner-specified insurance terms.
• Safety: Users must adhere to safety guidelines, including:
  
  • Using appropriate safety gear (e.g., helmets, harnesses).
  • Following manufacturer instructions and local regulations.
  • Ensuring equipment is operated by qualified individuals only.

11. Termination

• By VacationHobby: We may terminate or suspend your account or access to the Platform at our discretion for:
  
  • Violating these Terms or applicable laws.
  • Engaging in fraudulent or harmful behavior.
  • Failing to meet verification requirements.
• By You: You may terminate your account by contacting support@vacationhobby.com. Termination does not relieve you of obligations under existing Rental Agreements.
• Effect of Termination: Upon termination, you must cease using the Platform, and we may delete your account data, subject to legal retention requirements.

12. Disclaimer of Warranties

The Platform and Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to:

• Accuracy, availability, or legality of listings or equipment.
• Safety or suitability of paramotor equipment.
• Uninterrupted, secure, or error-free operation of the Platform.

Your use of the Platform is at your own risk. VacationHobby disclaims responsibility for any harm, loss, or damage resulting from your interactions with other Users or equipment.

13. Indemnity

You agree to indemnify, defend, and hold harmless VacationHobby, its affiliates, officers, directors, employees, and partners from any claims, losses, damages, liabilities, or expenses (including legal fees) arising from:

• Your misuse of the Platform.
• Violation of these Terms, laws, or third-party rights.
• Injury, damage, or loss caused by your use or listing of paramotor equipment.
• Disputes with other Users.

14. Governing Law and Arbitration

• Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
• Arbitration:
  
  • Any disputes arising from these Terms or your use of the Platform will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA) in Delaware.
  • Arbitration will be conducted on an individual basis; class actions or jury trials are waived.
  • You agree to first attempt informal resolution by contacting support@vacationhobby.com.
  • VacationHobby may seek injunctive relief in court to protect its rights, if necessary.
• Jurisdiction: For matters not subject to arbitration, you consent to the exclusive jurisdiction of Delaware state or federal courts.

15. Changes to Terms

We may update these Terms at any time to reflect changes in our Services, legal requirements, or business practices. Updates will be posted on the Platform and communicated via email or Platform alerts. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.

16. Communication Consent

By registering, you consent to receive electronic communications (e.g., SMS, email) from VacationHobby or our partners (e.g., Veriff, Twilio) for:

• Account verification and security.
• Booking confirmations and updates.
• Platform notifications and customer support.
• Marketing and promotional content (opt-out available).

Essential notifications cannot be opted out of while your account is active.
